Attorney General Ken Paxton has successfully secured additional legal protections for women in Texas’s educational institutions. The expanded court ruling prevents the Biden-Harris Administration from interpreting Title IX to include “sexual orientation” or “gender identity” as protected classes. This marks another win for Paxton, who has consistently opposed federal measures he believes undermine women’s rights.

In June 2023, Paxton sued the Department of Education (DOE) over guidance extending Title IX protections to these categories. The guidance would have required Texas schools to allow biological males in women’s restrooms and other sex-specific spaces, risking federal education funding for non-compliance.

Court Rules Biden’s Efforts Unlawful

In June 2024, a federal district court ruled the Biden Administration’s interpretation of Title IX as unlawful and vacated the rule. The judge expanded the ruling, enjoining any future DOE actions that attempt to rewrite Title IX to include “sexual orientation or gender identity” within the statute’s anti-discrimination provisions. This follows an injunction Paxton secured in July 2024 against another DOE rule redefining Title IX.

“This is a major win for protecting Texas and its students from any future attempt by the federal government to impose its unlawful interpretation of Title IX that puts women and girls at risk,” said Attorney General Paxton.

Attorney General Paxton has criticized the Biden Administration for attempting to subvert Title IX protections for women. He asserts that these policies have been “stopped in their tracks,” saving Texas schools and students from what he has labeled as illegal and dangerous mandates.

Nationwide Legal Implications

The ruling means Texas schools do not have to comply with the Biden Administration’s interpretation of Title IX regarding gender identity. They are shielded from losing federal education funding over non-compliance. Paxton stated that the Biden Administration’s actions were unlawful and a danger to women’s safety.

“Joe Biden’s unlawful effort to weaponize Title IX for his extremist agenda has been stopped in its tracks,” said Attorney General Paxton. “Threatening to withhold education funding by forcing states to accept ‘transgender’ policies that put women in danger was plainly illegal. Texas has prevailed on behalf of the entire Nation.”

U.S. District Judge Reed O’Connor criticized the DOE for not following proper procedures and for attempting to rewrite Title IX. He called the revised policies unlawful and prohibited their enforcement in Texas.
